MUMBAI: The South Mumbai District Consumer Disputes Redressal Forum recently ordered Go Air to pay Rs 14,500 to a Prabhadevi resident, who missed a crucial meeting in Chandigarh after his flight landed in Delhi due to poor visibility.
In January 2011, S K Tapuriah had booked a return flight to Chandigarh. The flight was delayed and left Mumbai at 1.30 pm, instead of 8.45 am. However, due to poor visibility, the flight was diverted to New Delhi. Tapuriah contacted the airlines and informed that as he had an urgent meeting in Chandigarh, he needed a taxi. The airlines declined to provide taxi and offered Rs 1,000. Tapuriah then booked a cab for Rs 4,500 and on his return sent notices to the airlines seeking a refund. Since the airlines did not respond favourably, he filed a compliant in the forum.
Tapuriah produced a copy of the ticket in the forum. The forum held that since the airlines had not filed their statements, the averment made by Tapuriah remained unchallenged. “Considering the aforesaid facts, we hold that complainant has proved deficiency in service on the part of opposite parties,” the forum said. The compensation includes cab fare refund with an interest of Rs 4,480 and Rs 10,000 towards costs of the complaint.
